Acceptance of terms
By accessing or using Aproplant, you agree to these terms. If you do not agree with them, please do not use the service.
Who operates Aproplant
Aproplant is operated by an individual, [Full Name], residing in [State], United States. Aproplant is not a company, corporation, or limited liability company. It is run by one person.
You can reach the operator through our contact page or by email at hello@aproplant.com. For privacy reasons, no street address is published; the contact page and email address above are the ways to reach the operator.
The service
Aproplant is a permaculture plant database with tools to browse plants, build curated lists, and share public presentation pages. The service is informational only and is intended to help you research and plan.
Eligibility and accounts
To create an account and accept these terms, you must be at least 18 years old, or the age of majority in your jurisdiction if that age is different. By using Aproplant, you represent that you meet this requirement and that you have the legal capacity to enter into these terms. This is separate from our Privacy Policy statement that the service is not directed at children under 13; the age requirement here is about your ability to agree to a binding contract.
Accounts are created and managed through Supabase Auth using your email address. You are responsible for your account and for the activity that happens under it, including keeping your access secure. You can request deletion of your account at any time through our contact page.
Ownership and intellectual property
The plant database, the design and layout of the site, and the Aproplant name, logo, and marks are owned by the operator and are protected by intellectual property laws. Your use of Aproplant gives you a limited, personal, non-exclusive license to use the service for its intended purpose. It does not give you ownership of, or the right to copy, resell, scrape, or redistribute, the underlying plant data or the site itself.
User-generated content
The lists you create, the items and notes within those lists, and any plant suggestions you submit are your content. You are responsible for the content you create and submit.
Do not submit content that is unlawful, infringing, or that you do not have the right to share. The operator may remove content that violates these terms.
So that the service can work, you grant the operator a limited license to store and display your content. This means displaying your lists, items, and notes back to you privately, and displaying the content of a list on a public presentation page when you choose to share it. This license exists only to run the features you use, and it ends when you delete the content or your account, subject to the retention terms described in our Privacy Policy.
Copyright complaints and takedown
If you believe that content submitted by a user (for example a list note or a plant suggestion) infringes your copyright, please tell us through our contact page or at hello@aproplant.com. Please describe the content, where it appears, and your rights in it. The operator will review good-faith notices and remove or disable access to content that is found to be infringing. This is an informal, contact-based process, and no formal copyright agent has been registered.
Advisory-only disclaimer
Plant, climate-match, and growing guidance (including climate fit scores and tiers) is advisory and informational. It is NOT professional agronomic, horticultural, legal, medical, or financial advice.
Much of the catalog data on Aproplant, including edibility information, invasive-species status, forest-layer and companion-planting guidance, climate and USDA suitability, and plant identification, is compiled from several sources and may be automatically generated, including by automated systems and artificial intelligence. It may contain errors, omissions, or content that is out of date. You should not rely on it as a sole source of truth.
In particular, please understand the following limits:
Plant identification may be wrong. The catalog may misidentify or mislabel a plant, so do not treat any listing as a confirmed identification of a plant you have in front of you.
Edibility, foraging, and toxicity information is not a safety guarantee, and getting it wrong can cause serious bodily harm. Many plants are toxic, and some can cause injury or death if handled or consumed. Do not eat, forage, taste, handle, or otherwise consume any plant based on information from this service without first independently verifying that it is safe.
Invasive-species and planting information is not a substitute for checking the law. Some plants listed here may be regulated, restricted, or prohibited in your area, and planting them can violate state or local law. You are responsible for checking your local regulations before planting.
Before planting or consuming anything, verify the information yourself with a qualified professional, such as a horticulturist, a poison-control resource, or your local agricultural extension office. Plant choices carry real-world risk, including invasiveness, toxicity, and suitability to your specific site conditions. Please do your own due diligence before making decisions. The service is provided “as is”, with no warranty of accuracy or fitness for a particular purpose.
Limitation of liability
To the extent permitted by law, the operator is not liable for any outcomes that result from using the guidance or the service, including any direct, indirect, incidental, or consequential loss. Because Aproplant is run by an individual and not an entity, this limitation is not a promise that no one can ever be held responsible; it sets out the operator’s contractual position to the extent the law allows.
Indemnification
You agree to indemnify and hold the operator harmless from any claims, losses, or costs (including reasonable legal fees) that arise from the content you submit, your misuse of the service, or your breach of these terms.
Acceptable use
Do not scrape the service, abuse it, or attempt to break authentication or rate limits. The contact and suggest-a-plant forms are protected by Cloudflare Turnstile.
Fees
The service is currently provided free of charge. The operator may change the service or introduce paid features in the future. If that happens, any paid features and their pricing will be described before you are asked to pay for them.
Termination
The operator may suspend or terminate your account if you violate these terms. You may stop using the service and request account deletion at any time. When an account is terminated or deleted, your data is handled as described in the retention and deletion section of our Privacy Policy.
Governing law and venue
These terms are governed by the laws of the State of [State], United States, without regard to its conflict-of-law rules. You agree that any dispute that is not resolved informally, and that is not brought in small claims court, will take place in the state or federal courts located in [State].
Dispute resolution
If you have a dispute with the operator, we ask that you first try to resolve it informally. Before starting any formal legal action, please send a written notice describing the dispute through our contact page. Both sides then have 30 days to try to resolve the matter in good faith.
This informal step does not stop either side from bringing a claim in small claims court, which remains available to you at any time.
These terms do not require you to submit any dispute to a private arbitrator, and they do not ask you to give up your right to take part in a class or representative action. You keep your right to bring an individual claim in court after the informal resolution period, and you are not required to waive participation in any class or representative action.
Changes to the service and terms
The service and these terms may change over time. Your continued use of Aproplant means you accept the current terms. The “Last updated” date at the top of this page reflects the current version.
General terms
Severability: if any part of these terms is found to be unenforceable, the rest of the terms stay in effect.
Entire agreement: these terms are the complete agreement between you and the operator about your use of Aproplant, and they replace any prior discussions or understandings on that subject.
Waiver: if the operator does not enforce a part of these terms right away, that is not a waiver of the right to enforce it later.
Assignment: you may not assign or transfer these terms to anyone else. The operator may assign these terms, for example if the service is transferred to another person or entity.
No third-party beneficiaries: these terms are between you and the operator only, and they do not create rights for any other person or party.
